The following General Terms and Conditions also contain legal information about your rights under the regulations on distance contracts and electronic commerce.

1 SCOPE, CONTRACTUAL PARTNERS

1.1 These General Terms and Conditions (“GTC”) apply to all contracts concluded between you as a customer (“you”) and the company nacani GmbH (“nacani”) as operator of the online store at www.nacani.de (“nacani-Webshop”). During the order process you accept the general terms and conditions in the version valid at the time of placing the order. Deviating or supplementary general terms and conditions of the customer are only valid as far as nacani has agreed to them in text form in individual cases.

1.2 These GTC apply to consumers. According to the legal definition (§13 BGB), a consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.

2 CONTRACT

2.1 The presentation of the products in the web store does not yet include a binding offer of sale. The goods selected by you are initially collected in a virtual shopping cart. Goods in the shopping cart are not reserved for you and can be purchased by other customers in the meantime. After providing your contact details, payment and shipping information, you make a binding offer to purchase by clicking on the order button itself. Before doing so, you have the opportunity to check your information and change it if necessary or correct input errors. Your binding order can only be sent if you have expressly accepted these terms and conditions. The offer to conclude a purchase contract is made by you as the customer by clicking the button [Bestellung abschicken].

2.2 A confirmation of the receipt of your order will be sent by an automated e-mail immediately after sending your order; this does not yet represent an acceptance of the contract by nacani, but only serves as information for you.

2.3 The contract is only concluded by an explicit order confirmation by e-mail from nacani or by shipment of the ordered goods.

3 DELIVERY, AVAILABILITY OF GOODS, RIGHT OF WITHDRAWAL

3.1 The delivery time starts as soon as the full payment of the purchase price is received. Your order will be prepared for shipment and shipped to you within two to three business days after we receive the purchase price.

3.2 After your order is shipped, you will receive an email with a tracking number that you can use to track your order online.

3.3 If an ordered product is not available, nacani can reject your purchase offer. In this case nacani will inform you immediately and refund any consideration already paid without delay.

4 PRICES, SHIPPING COSTS, CUSTOMS DUTIES

4.1 The final prices stated in the webshop include the statutory value added tax. The prices stated apply to deliveries to countries of the EU including the value added tax applicable to Germany.
Prices for deliveries to countries of the European Union (“EU”) are quoted in euros (EUR). Any refunds will also be made on the basis of the original payment made by you without taking into account changing exchange rates.

4.2 The purchase price is due immediately after conclusion of the contract.

4.4 In the case of a shipment to non-EU countries, additional taxes and costs (e.g. customs duties) may be incurred within the scope of your order, which cannot be paid via us or invoiced by us, but must be paid by you directly to the responsible customs or tax authorities. Please contact these authorities for details.

5 PAYMENT, RETENTION OF TITLE, INSURANCE

5.1 We accept only the payment methods that are displayed when you place your order: Credit card payments with VISA and MASTERCARD, payment by PAYPAL and SOFORTÜBERWEISUNG, direct bank transfer or SEPA direct debit.

When paying by SOFORT TRANSFER, the payment is processed by SOFORT GmbH, Fußbergstraße 1, 82131 Gauting.

When paying by credit card or other payment method where your account is not in the currency specified at the time of purchase, your account will be charged based on the exchange rate in effect when the transaction is settled by and determined by your card provider or payment service provider.

Your Paypal payment will be processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. The respective conditions of the contractual partners apply. If you pay with PayPal, you will be redirected to the PayPal page at checkout, where you can log in and complete the payment process. Once the payment has been made, you will be redirected back to nacani.

All transactions on this website are processed through STRIPE. This is a secure online payment portal where your payment details are encrypted in a secure host environment.

nacani GmbH also offers you the option to store your credit card details so that you can shop with us more quickly and easily. Your credit card number is not displayed in full – only the last four digits are visible. This allows you to quickly and easily identify which of your credit cards you are using. You can delete your credit card details at any time by deactivating the “Save my payment methods” function on the payment page.

5.2 Until full payment the delivered goods remain the property of nacani.

5.3 During transport, your order is insured by nacani until the time of delivery. With delivery and signature the liability for the purchased items is transferred to you. If you are not the recipient (for example in case of a gift), then you accept the fulfillment of the contract by nacani and the transfer of liability to the recipient.

6 LEGAL RIGHT OF WITHDRAWAL / RETURN

6.1 Consumers have a legal right of withdrawal when concluding a distance selling transaction, about which nacani informs below according to the legal model.

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the goods. If you have ordered several goods as part of a single order and these goods are delivered separately, the withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the last goods.

In order to exercise your right of withdrawal, you must inform us (nacani) by means of a clear declaration (e.g. a letter sent by post or an e-mail) of your decision to withdraw from this contract.

In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

EXCLUSION OF THE RIGHT OF REVOCATION

Packages that have already been opened cannot be returned unless a clear product defect is identifiable.

CONSEQUENCES OF REVOCATION
If you revoke this contract, all payments that nacani has received from you, including the delivery costs (however, with the exception of any costs resulting from the fact that you have chosen a type of delivery other than the offered, most favorable standard delivery), will be refunded to you without undue delay and at the latest within fifteen days from the day on which we received the revoked goods. For this repayment, the same means of payment will be used that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees because of this repayment. Repayment may be refused until nacani has received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You shall return or hand over the goods without undue delay and in any case not later than within fourteen days from the day on which you notify nacani of the revocation of this contract. The deadline is met if you send the goods before the end of the period of fourteen days.

You shall bear the direct costs of returning the goods. The return shipment must be sent back to nacani insured and traceable. You only have to pay for any loss in value of the goods if this loss in value is due to the handling of the goods which is not necessary for the inspection of the condition, properties and functioning of the goods.

Please return only items that are new and unopened. The goods must also be returned complete, i.e. in the original sales packaging together with any instructions and undamaged seals or other components. Returns that do not comply with this will not be accepted and will be returned to you.

7 LEGAL WARRANTY

Your rights in case of material defects and defects of title are determined by the legal regulations. nacani is only liable for damages according to clause 8. 8.

8 LIABILITY FOR DAMAGES

8.1 nacani is liable for damages according to the legal regulations, as far as nothing else is determined in the following.

8.2 In case of breach of duty – regardless of the legal reason – nacani is liable for intent and gross negligence within the scope of fault liability. Subject to a milder measure of liability according to legal regulations (e.g. for diligence in own affairs) nacani is only liable in case of simple negligence:

for damages resulting from injury to life, body or health and
for damages resulting from the not insignificant breach of an essential contractual obligation (obligation, the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which the contractual partner regularly relies and may rely); in this case, however, the liability is limited to the compensation of the foreseeable, typically occurring damage.

The aforementioned limitations of liability also apply to third parties as well as to breaches of duty by or in favor of persons whose fault nacani is responsible for according to legal regulations.

12 FINAL PROVISIONS

12.1 These General Terms and Conditions and the contractual relationship with you shall be governed by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

12.2 If the customer places an order via our webshop, only the English version of these terms and conditions applies.

12.3 Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.
